GENERAL TERMS AND CONDITIONS

Applicable to Business Clients (B2B) and Private Individuals (B2C)

 

1. Scope of Application

These General Terms and Conditions (GTC) govern the contractual relationship between Natalie Botsch / NBeyond (hereinafter referred to as the 'Provider') and their clients, including both corporate (B2B) and private (B2C) customers. They apply to all services offered, including individual coaching sessions, team workshops, leadership trainings, keynote speeches, music and creative performance formats. Any deviating terms and conditions proposed by the client shall only apply if expressly confirmed in writing by the provider.

 

2. Description of Services

The provider offers professional services in the fields of coaching, training, leadership development, business consulting and creative stage formats. The approach integrates professional expertise, participatory methods, and creative components such as music and storytelling. It is expressly noted that the services do not constitute medical, psychological, or therapeutic treatment and are not a substitute for such. The offerings are designed to support personal growth, strengthen leadership qualities, and foster healthy team dynamics.While the provider ensures high-quality delivery, no guarantees are made regarding specific outcomes, as the effectiveness depends significantly on the active participation and individual commitment of the client or participants.

 

3. Contract Conclusion and Booking

Requests can be made via email, phone, or contact form. A booking becomes binding only after a written confirmation is provided by the provider. Only with this confirmation does a legally valid contract come into effect. The provider reserves the right to reject a booking request, especially if the offered service does not align with the client’s context or requirements.

 

4. Fees and Payment Terms

Unless otherwise agreed, all services must be paid in advance via bank transfer (prepayment). Invoices will be issued promptly and include all necessary payment details. Prices for B2B clients are quoted excluding VAT (currently 19%), while B2C clients receive gross prices including VAT. If payment is not received on time, the provider reserves the right to withdraw from the agreement or suspend performance of services until full payment is made.

 

5. Cancellation and Rescheduling

Cancellations or rescheduling must be submitted in writing. The following cancellation terms apply:

• Cancellations made 14 or more calendar days before the scheduled appointment are free of charge.

• Cancellations made between 13 and 7 calendar days before the appointment will be charged at 50% of the agreed fee.

• Cancellations made less than 7 calendar days in advance will be charged at 100% of the agreed fee.

In cases of force majeure or illness (with a valid medical certificate), both parties will seek a fair and solution-oriented agreement, such as rescheduling the session.
If the provider is unable to deliver the agreed service due to illness or unforeseen circumstances, an alternative date will be offered. Further claims, especially for damages, are excluded.

 

6. Liability

Participation in all services is at the participant's own risk. The provider accepts no liability for physical, psychological, or financial damage resulting from participation. The services offered are not therapeutic. Clients are responsible for assessing their own physical and mental health. If in doubt, they should seek medical or psychological advice before participation. The provider is not liable for damage caused by improper use of materials, instruments, or negligence during events. Participants are asked to take care of their own safety and that of others.

 

7. Confidentiality

The provider commits to treating all personal, internal, and business-related information obtained during the collaboration as strictly confidential. This confidentiality obligation remains in effect beyond the termination of the agreement.
No data or content will be shared with third parties or made public without prior written consent.

 

8. Intellectual Property and Usage Rights

All materials, concepts, texts, musical content, and creative works provided by the provider are protected by copyright. Any use, duplication, sharing, or publication of this content by clients or third parties is not permitted without explicit prior written permission. The provider reserves the right to use original or properly licensed music in public performances, including legally covered versions.

 

9. Data Protection

Personal data will be collected and processed solely for the purpose of contract execution, communication, and billing. All data will be handled confidentially and in accordance with the EU General Data Protection Regulation (GDPR). A detailed privacy policy is available on the provider’s website.

 

10. Applicable Law and Jurisdiction

All legal relationships between the provider and the client are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is the provider's business location, unless otherwise required by mandatory legal provisions.

 

11. Severability Clause

Should any provision of these GTC prove to be wholly or partially invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid one that comes as close as possible to the original intent in economic terms.

 

12. Preliminary Status of the GTC

These General Terms and Conditions are issued as a preliminary version and remain valid until further notice. Updates or adjustments will be communicated in due time and will become binding upon publication. Nevertheless, this version is legally binding for all current contractual relationships.
